Privacy Policy

This is the Data Privacy Policy (“Privacy Policy”) of Executive Title Agency, Ltd. (“Company,” “we,” “us,” or “our”).  We maintain websites, portals, and other applications (the “Sites”) to provide services to you.  These Sites may collect personal information in order to deliver our services, enhance your experience, and provide information about our service offerings.  This Privacy Policy applies to activities Company engages in both online and offline. 

This Privacy Policy explains: 

  • What personal information we collect; 

  • How we use and share that information; 

  • Your rights under state and federal law, including RESPA, TILA, the Texas Department of Insurance (TDI), and Florida Department of Financial Services (DFS) regulations; and 

  • How you can contact us with questions or requests. 

1. Notice at Collection 

At or before we collect personal information, we provide you with this Privacy Policy or a short form notice summarizing: 

  • The categories of personal information we collect (e.g., identifiers, financial data, geolocation data, internet activity, and the like as it relates to our service offerings); 

  • The purposes for which we use this information (e.g., to process transactions, comply with legal requirements, communicate with you, provide services, and detect/prevent fraud and the like as it relates to our service offerings); 

  • Whether we share data with third parties (we do not sell personal information). 

By continuing to interact with our Sites, submitting information, or using our services, you acknowledge that you have received this notice. 

2. Personal Information We Collect 

We may collect personal information from you in a variety of ways, including, but not limited to, on our Sites, through email, SMS text, by mail, over the phone, or in person at one of our locations.  The type of information we collect depends on your interactions with us. 

3. Examples of Information Collected 

  • When you visit our Sites: Name, address, email address, phone number, geolocation, IP address, demographic data, and areas of interest. 

  • When you open an order or request services: Legal name, physical address, email address, telephone number, marital status, driver’s license/state ID, date of birth, Social Security number, financial account information (collected via secure third-party processor), purchase price, and earnest money payment information. 

  • When you communicate with us: Name, contact details, account information, and any content of your communications (feedback, questions, or requests). 

  • When you apply for employment: Name, contact information, work history, and other data you choose to provide. 

  • Automated Information: IP address, browser type, device type, date/time of access, pages visited, links clicked, referring/exit pages, and usage behavior. 

We may also collect information from affiliates, underwriters, public records, credit bureaus, or other third-party data providers as necessary to fulfill our obligations under RESPA, TILA, and other applicable laws. 

4. Sensitive Personal Information 

If we collect information defined as “sensitive personal information” under applicable law (e.g., citizenship or immigration status, precise geolocation, racial or ethnic origin), we will use such data only as permitted by law and will seek consent where required. 

5. Minors 

Our Sites and services are not directed to children under 13, and we do not knowingly collect their personal information.  If we learn that we have inadvertently collected such information, we will delete it. 

6. How We Use Your Personal Information 

We collect and use your information to: 

  • Fulfill our legal and contractual obligations under RESPA, TILA, and state regulations, including escrow and settlement services. 

  • Establish, service, and maintain accounts. 

  • Communicate with you regarding your transactions, orders, or inquiries. 

  • Process payments through secure third-party payment processors. 

  • Prevent fraud, unauthorized transactions, and security incidents. 

  • Conduct internal research and improve our Sites and services. 

  • Provide marketing, offers, and updates (with your consent where required). 

  • Respond to legal or regulatory requests, including TDI and DFS examinations. 

7. How We Share Personal Information 

We do not sell personal information.  We may share information as follows: 

  • Affiliates/Subsidiaries: For business purposes and to fulfill your order. 

  • Service Providers and Vendors: For IT hosting, document preparation, payment processing, title plant access, marketing, analytics, and related services. 

  • Regulatory and Legal Compliance: To government agencies (including TDI and DFS) or courts as required by law. 

  • Business Transfers: In connection with a merger, sale, or reorganization of our business. 

All third parties receiving information must protect it and use it only for authorized purposes. 

8. Cookies and Tracking 

We use cookies, pixels, and other tracking technologies (“Data Technologies”) to: 

  • Maintain session information and security; 

  • Understand Site performance and usage; 

  • Deliver relevant marketing. 

You may disable cookies through your browser, though when you do so certain features may not function properly.  Our Sites currently do not respond to Do Not Track signals.  We use Google Analytics; you may opt out via Google Ads Settings (https://adssettings.google.com) or the Google Analytics Opt-Out Browser add-on (Google Analytics opt-out browser add-on - Analytics Help). 

9. Your Privacy Rights 

Texas Residents – Texas Data Privacy and Security Act (TDPSA) 

You have the right to: 

  • Access your personal information; 

  • Correct inaccuracies; 

  • Delete personal information (subject to legal record retention obligations); 

  • Obtain a portable copy of your data; 

  • Opt out of targeted advertising or profiling.

California Residents – Consumer Privacy Act (CCPA) and Privacy Rights Act (CPRA) 

California consumers have the right to know what personal information we collect and access it and/or receive a copy of it, request deletion, request correction, to not receive discriminatory treatment because you exercise these rights, and to opt out of sale or sharing (we do not sell or share data as defined by law).  You may designate an authorized agent to make these requests on your behalf.  California consumers can exercise their rights directly or through an authorized agent by using the contact methods below.

  

Florida Residents – Florida Digital Bill of Rights (FDBR) 

Florida consumers have the right to know what personal information we collect, to access the personal information, to correct inaccuracies in the personal data, to delete the personal data, to obtain a copy of the personal data in readily usable format, to opt out of processing of the personal data, and to opt out of the collection and processing of sensitive data including precise geolocation data.

Exercising Your Rights You may exercise these rights using the contact methods below.  We will respond to your request within 45 days of receipt.  If we require additional time (up to 45 additional days), we will inform you of the extension and the reason for it. 

10. Security and Retention 

We use administrative, technical, and physical safeguards to protect your data, including encryption where appropriate.  We retain information only as long as necessary to meet business needs, legal requirements, and regulatory retention schedules. 

11. Changes to This Policy 

We may update this Privacy Policy from time to time.  If we make material changes, we will update the effective date and post a notice on our Site.
